I Definitions and Preamble

§ 1. These Rules determine the conditions of using the alumni base at http://baza.szkola-liderow.pl, in particular the rights and obligations of the registered users of the School for Leaders Alumni Base.

§ 2. Each time there is mention of the following in the Rules: 
1) Rules – they are to be understood as these rules which determine in particular the conditions of participation in the School for Leaders Alumni Base, the rights and obligations of the School for Leaders and the Alumni with regard to providing services via Internet, the conditions of providing services via Internet, the principles of personal data protection, as well as the rules which determine the scope of responsibility of the School for Leaders arising from providing the services, 
2) School for Leaders – it is to be understood as the School for Leaders Association with headquarters in Warsaw (postal code 00-010 Warsaw) at the Sienkiewicza Street 12/14 room 4D19, registered in the Register of Associations, other Social and Professional Organizations, Foundations and Public Complexes of Health Care Facilities of the National Court Register run by the District Court for the City of Warsaw in Warsaw, the 12th Economic Department under the number KRS 0000137605, REGON (statistical number) 012493246, NIP (TAX ID) 526-17-67-571,
3) baza.szkola-liderow.pl – it is to be understood as an internet service available at the address http://baza.szkola-liderow.pl; the only owner of baza.szkola-liderow.pl is the School for Leaders Association, 
4) User – He/she is to be understood as a physical person who by accepting the Rules and completing the registration procedure gains access to the services offered by the Alumni Base of the School for Leaders  within baza.szkola-liderow.pl service, 
5) Profile – it is to be understood as a place in baza.szkola-liderow.pl where collection of information on the User is posted, including the required personal information posted according to the conditions determined in the Rules and in the annexes to the Rules, 
6) Account – it is to be understood as a record existing in the data base of baza.szkola-liderow.pl that confirms the fact of being a User, which results in the following: the access to services after providing the login and the password, the possibility to modify the data posted in the Profile, the possibility to modify the Account settings 
7) Administrators – they are to be understood as the people assigned by the School for Leaders who are responsible for running baza.szkola-liderow.pl, including in particular providing technical support for the Users, taking care of order and ensuring that Users observe the provisions of the Rules.

§3. baza.szkola-liderow.pl is a social network which makes it possible for its Users to establish contacts, to exchange information and experiences, as well as to post and to promote information about themselves.

II Concluding and terminating agreements for services provided via Internet.

§ 4. The User of baza.szkola-liderow.pl can only be an adult physical person.

§ 4a. The physical person can be a User of baza.szkola-liderow.pl provided that: 
1) he/she has full legal capacity or 
2) he/she receives the approval of the statutory representative in case he/she has limited legal capacity.

§ 5. 
1. By registering the Account the User accepts all the provisions of these Rules and agrees to observe them. 
2. If the User withdraws his/her consent with any of the provisions of the Rules, he/she must immediately remove his/her Account and inform the Administrators about withdrawing such consent.

§ 6. 
1. The Agreement for services provided via Internet is deemed concluded from the moment when the Users start using the services provided by the School for Leaders within baza.szkola-liderow.pl. The Users start using the services by submitting the completed registration form. The services are solely provided to the registered Users after they log in to the Account. 
2. The agreement is concluded for an undefined period of time. 
3. Each party can terminate the Agreement for services provided via Internet without stating the reasons and with immediate effect. 
4. School for Leaders terminates the Agreement by having the User's Account removed by Administrators. 
5. The User terminates the Agreement by submitting the request to have his/her Account removed by Administrators. 
6. If the request to have the Account removed is submitted to the Administrators according to the § 6. par. 5 point 2), the termination of the Agreement comes into life after the period of notice of 72 hours.

§ 6a. School for Leaders reserves the right to remove the User's Account if his/her actions are judged as harmful for baza.szkola-liderow.pl

§ 7. 
1. Access to the services of baza.szkola-liderow.pl is free.

§ 8. School for Leaders reserves the right to any modification of services and tools or the way of functioning of baza.szkola-liderow.pl, including the removal of any data collected in the base, the disruption of activity, the transfer of rights to baza.szkola-liderow.pl and the undertaking of any actions permitted by law with regard to the service. The User is not entitled to any claims against the School for Leaders in reference to the indicated actions.

§ 8a. The User concedes the School for Leaders the right to present him commercial materials and recruitment announcements, as well as to send him/her such materials and announcements to his/her post-box with his/her approval.

§ 9. baza.szkola-liderow.pl is generally an open site - the data provided by the User is unclassified information, available for public information in the User's Profile. It is particularly available for the people who use Internet and can be indexed by search engines.

§ 10. In order to use the free-of-charge services provided by the School for Leaders within baza.szkola-liderow.pl it is necessary to open an Account. The User creates the Account by completing the registration form providing complete compulsory data, reading and accepting these Rules.

§ 10a. baza.szkola-liderow.pl is compatible with the most popular Internet browsers.

§ 11. The services specified in § 3 are provided, among others, by: 
1) enabling the User to create a publicly available Profile, 
2) enabling the User to send private messages to other Users, taking into account the objections determined in these Rules, 
3) enabling the User to create the list of contacts by providing the option of inviting and receiving invitations from other Users.

III Registration and Account

§ 12. Registration consists of completing the form that is available at the address http://baza.szkola-liderow.pl/logowanie.php

§ 13. The User has to provide in particular the following data: first name, surname, email address and password, as well as to enter the name of the town, the region, the full address, his/her organization and to select the programs or editions in which he/she participated. The data is to be entered in the appropriate profile fields. The fields may only contain the data for which they are intended. If the User removes this data, he/she will loose the possibility to use the service.

§ 14. The User is responsible for updating his/her information in his/her Profile.

§ 15. If it is discovered that the User has provided false or out-of-date data, the Administrators have the right to: 
1) ask the User to remove the irregularities immediately, 
2) block the User's Account till the issue has been solved, 
3) remove the User's Account in the mode determined in § 6 par. 3 and 4.

§ 16. If there are justified doubts with regard to the authenticity of the data entered by the User, the Administrators can ask for appropriate documents confirming this data.

§ 17. The processing of the personal data included in the registration form and the data shared in the Profile created by the User is carried out with the User's consent expressed at the registration in baza.szkola-liderow.pl. School for Leaders processes the User's data in accordance with the Policy of Privacy Protection presented in the Annex number 1 and according to the law from the 29th August, 1997 about the personal data protection (uniform text: Dz. U. [Law of Journals] from 2002, No. 101, item 926 as amended) and to the law from the 18th July, 2002 about providing services via Internet (Dz. U. [Law of Journals] No. 144, item 1204 as amended).

§ 18. The registration procedure in baza.szkola-liderow.pl, which results in the Account creation, can be carried out only if the User: 
1) ensures and declares that he/she read and accepted the entire content of the Rules, 
2) accepts that his/her personal information shall be processed according to the provisions of these Rules and displayed (according to the marked options) in the Profile, 
3) confirms the authenticity of the data provided in the registration form, 
4) agrees to receive system notifications at the email address indicated in the registration form, including notifications about new messages, invitations in the mailbox of baza.szkola-liderow.pl, technical brakes in the functioning of baza.szkola-liderow.pl, changes to the Rules and new functionalities.

§ 19. The User is not allowed to have more than one Account.

§ 20. The User is not permitted to share the Account with other entities.

§ 21. It is forbidden to use the Accounts that belong to other entities.

IV Personal information and privacy policy

§ 22. The Administrator of the personal information shared by the User is the School for Leaders Association with the headquarters in Warsaw at the Sienkiewicza Street 12/14, room 4D19, 00-010 Warsaw. School for Leaders processes the User's personal information to the extent necessary to make reference to, to shape the content, to change, to terminate and to provide the services offered via Internet in a correct manner. With the User's consent the School for Leaders processes his/her data in a wider extent than it is obligatorily required at the User's registration. The data shared by the User is processed for the needs related to the usage of the services provided in baza.szkola-liderow.pl and with the User's consent the data can be processed by the School for Leaders for statistical and marketing purposes. The data can only be shared with public authority bodies that have authorized access to the data on the ground of the appropriate law regulations.

§ 23. School for Leaders processes personal information in accordance with the binding regulations on the grounds of the principles determined in the Policy of Privacy Protection of baza.szkola-liderow.pl which forms the annex number 1 to these Rules, in particular those related to the proper way of securing data.

§ 23.1 The User's data, materials or statements can be processed by the School for Leaders for the needs of recruitment process.

V The use of services provided by the School for Leaders within baza.szkola-liderow.pl

§ 24. It is forbidden to undertake any actions that may hinder or destabilize the functioning of baza.szkola-liderow.pl. If the Administrators discover that the User undertakes such actions, his/her Account shall be removed immediately. The User's activity that aims to destabilize the service may also be deemed a crime as defined by the Criminal Code.

§ 25. The User is responsible in particular for: 
1) refraining from undertaking any actions that may hinder or interfere with the functioning of baza.szkola-liderow.pl and from using the services of the portal in the way which is uncomfortable for other Users, 
2) observing proprietary copyrights resulting from the ownership to the pictures posted
3) refraining from any actions that may breach the other Users' privacy, in particular from collecting, processing and distributing information about other Users without their explicit consent unless it is permitted by the law regulations and these Rules.

§ 26. It is forbidden to post in baza.szkola-liderow.pl and to distribute with the help of it the following: 
1) software encumbered with the rights of third parties - without an appropriate authorization, 
2) software intended to illegally destroy, change, remove, damage, hinder access to IT data or to significantly interfere with or prevent the automatic processing, collecting and transmitting of such data, as well as to interfere with the work of the systems and IT networks, 
3) computer passwords, access codes or other data which enable unauthorized access to information stored in the computer system or IT network.

§ 27. It is forbidden to post in baza.szkola-liderow.pl any content that is illegal, offensive, untrue, not in accordance with the generally applicable law and content that promotes violence, is morally wrong or contrary to good practice. The Administrators can remove such content and their authors’ Accounts.

§ 28. 
The User can only post the pictures that present his/her person in the way that makes it possible to recognize him/her. The User agrees to the distribution and public sharing of his/her image posted by him/her in baza.szkola-liderow.pl service. It is forbidden to post pictures of other people and all kind of graphic compositions. It is allowed, due to the properties of digital format, to retouch the pictures provided that the retouching will consist in applying global correction that improves the quality (e. g. saturation, contrast). It is not allowed, however, to use selective measures in order to add or subtract elements, to join pictures together or to change the original composition of the picture. It is forbidden to post the pictures of pornographic nature or the pictures that don't correspond with the professional character of baza.szkola-liderow.pl.
The Administrators may remove the pictures they deem inappropriate without any warning and necessity to inform the User about this fact. 
A continuous posting of inappropriate pictures shall result in the removal of the User's Account.

§ 29. School for Leaders reserves the right to modify or to remove the Profile if its content is not in accordance with the Rules or has negative impact on the image of baza.szkola-liderow.pl.

§ 30. It is forbidden to use the services of baza.szkola-liderow.pl, and in particular to use private messages to distribute advertisements of products, services, commercial Internet services or other content regarded as spam.

§ 31. The User who posts the materials in the form of a statement on the forum (message board) releases any claim of ownership against the School for Leaders arising from the free-of-charge usage (including the removal from baza.szkola-liderow.pl without providing the reason) of this content.

§ 31a. The provision determined in § 31 also applies to the content of the character of copyright work.

§ 32. The User agrees to maintain proper language standards on the forum and to avoid any kind of personalities, arguments ad personam and other reprehensible behaviours. The statements are evaluated in a unilateral way by Administrators or by the people assigned by them.

VI Copyright law

§ 33. By posting his/her data, image, materials or statements in szkola-liderow.pl the User accepts that they shall be used by other Users for their personal needs and for the needs of the recruitment and promotion campaigns of baza.szkola-liderow.pl.

§ 34. The User is authorized to use the data, the images, the materials or the statements that comprise the work within the meaning of the law from the 4th February, 1994 about copyright and ancillary rights (Dz. U. [Journal of Laws] 1994, No. 24, item 83 as amended) and those which don’t comprise the work within the meaning of the above mentioned law, posted in baza.szkola-liderow.pl for personal use. Using of the data, the materials and the statements mentioned above in a different way is acceptable only with the consent of the authorized person or on the grounds of the regulations of law and these Rules.

§ 35. The User who posts the content of the character of a copyright work in baza.szkola-liderow.pl releases any claim of ownership against the School for Leaders arising from the free-of-charge usage (including the removal from baza.szkola-liderow.pl without providing the reason) of this content.

§ 36. The User doesn't grant the School for Leaders the right to use and distribute free of charge the data or statements posted by him/her, presented as a part of the whole (e. g. visualization of the list of contacts or discussion on the forum illustrated with the real existing data) in the presentations or other materials.

VII Responsibility

§ 37. School for Leaders is not responsible for the content and the form of materials and information posted by the User in baza.szkola-liderow.pl.

§ 38. School for Leaders is not responsible for the content of private messages sent by Users. The Users who send messages that infringe the law or the rights of the third parties can bear criminal or civil responsibility arising from their actions.

§ 39. The User bears full responsibility for breaking the law or for the damage resulting from his/her actions in baza.szkola-liderow.pl, in particular from providing false information, disclosing official secret or other confidential information, infringing personal rights or copyright and ancillary rights.

§ 40. School for Leaders stipulates that using baza.szkola-liderow.pl and the services provided by the portal takes place at the User's own risk. No information or materials posted in the base, nor services delivered via baza.szkola-liderow.pl are covered by the guarantee with regard to their value, usability, comprehensiveness, completeness or usefulness.

§ 41. 
1. School for Leaders is not responsible for technical and legal faults of the services offered or for the proper quality of the services. Nor is it responsible for the effects of the failure to perform or improper performance of undertaken obligations or capacities of these people to undertake obligations via baza.szkola-liderow.pl. 
2. The responsibility of the School for Leaders for the proper quality of the chargeable services is defined by special rulings that provide the basis for chargeable services.

§ 42. School for Leaders doesn't guarantee the correct functioning of baza.szkola-liderow.pl as a whole or partially.

§ 42a. If School for Leaders receives legal notice about illegitimate nature of the stored data delivered by the User and makes it impossible for him to get the access to this data, School for Leaders shall not be responsible against this User for the damage arising from removing access to this data.

§ 43 School for Leaders is not responsible for potential damages resulting from errors, failures or brakes in the functioning of baza.szkola-liderow.pl.

VIII Complaints

§ 44. The User can make a complaint with regard to the interruptions in the functioning of baza.szkola-liderow.pl and to problems or remarks connected to the services provided within baza.szkola-liderow.pl reporting them via the Help panel.

§ 45. School for Leaders will investigate a complaint within the period of 14 days from the date of receiving it. School for Leaders reserves the right not to consider further the complaint if it results from the ignorance of these Rules, the annexes or the rules of law.

§ 46. School for Leaders reserves the right to tamper with the User's Account in order to remove the interference or problem with regard to the functioning of the Account or service of baza.szkola-liderow.pl.

§ 47. The complaints submitted to the School for Leaders and related to the services provided by the third parties via baza.szkola-liderow.pl shall not be considered. School for Leaders has no obligation to pass the complaint to the appropriate entity responsible for handling the complaint.

IX Temporary and final regulations

§ 48. School for Leaders reserves the right to unilaterally change the Rules without having to justify the reason for such a change.

§ 49. 
1. School for Leaders agrees to notify about the significant change the Users to whom the change directly refers by email. 
2. The User bears responsibility for providing the email address to which he/she has no access, in particular an inappropriate address or the address that belongs to another entity, as well as for the consequences arising from this fact such as not receiving the notification determined in par. 1. 
3. The User bears the risk of not receiving the notification determined in the par. 1 due to the reasons independent from the School for Leaders.

§ 50. If the Rules are changed the list of the most important changes will be displayed to the User after he/she logs in to his/her Account. The User is responsible for getting familiar with the new version of the Rules. By clicking the formula "I hereby declare that I have got familiar with the new version of the Rules, I understand and accept them as a whole" the User declares the will to remain in a contractual relationship with the School for Leaders on the conditions defined in the new version of the Rules.

§ 51. 
1. These Rules enter into force on the 1st April, 2010. 
2. § 51 applies mutatis mutandis except the sentence: "If the Rules are changed the list of the most important changes will be displayed to the User after he/she logs in to his/her Account".
